ATS Connection Broadband Services Terms and Conditions

1. Introduction

These Terms and Conditions govern the provision of broadband services (“Services”) provided by ATS Connection. By using our Services, you agree to comply with these terms.

2. Service Provision

2.1 Eligibility: Our broadband services are provided exclusively to businesses and are not intended for personal, consumer use.

2.2 Service Quality: ATS Connection will use reasonable efforts to ensure continuous and uninterrupted broadband service. However, you acknowledge that service availability may depend on factors such as location, network congestion, and external circumstances.

2.3 Geographical Limits: Service availability may be limited by geographical location and technical constraints.

3. Customer Responsibilities

3.1 Access to Service: You must ensure that your business has the required infrastructure to access the broadband service, including necessary hardware and network equipment.

3.2 Use of Service: You agree not to misuse the broadband service for illegal purposes or activities that may compromise the performance of the network.

3.3 Reporting Issues: You are responsible for notifying ATS Connection immediately if there are any issues with the service, such as connectivity problems or network outages.

3.4 Openreach Engineer Callout: In cases where an Openreach engineer is required to attend your site due to a service issue, and it is found that the issue originates locally within your property (e.g., internal wiring, equipment failure), an additional charge of £180 will apply.

4. Billing and Payment

4.1 Fees: Fees for the broadband services will be charged based on the service plan you have selected. Any additional usage or overage charges will be billed separately.

4.2 Price Increases: ATS Connection reserves the right to increase prices by up to 9.6% annually. You will be notified at least 30 days in advance of any price increases.

4.3 Payment Terms: Payment for services is due within 14 days of the invoice date unless otherwise specified. Late payments may incur interest or service suspension.

5. Service Suspension and Termination

5.1 Suspension: ATS Connection reserves the right to suspend or restrict service if payments are not received or in the event of misuse of the service.

5.2 Termination: Either party may terminate the service agreement with 30 days’ written notice after the initial contract period. Any outstanding balances must be settled before the termination.

6. Contract Length and Cancellation

6.1 Contract Length: The length of the broadband service contract is specified in your signed service agreement.

6.2 Early Cancellation: Should you decide to cancel the contract early, you will be charged a £50 administrative fee, along with any remaining fees due for the remainder of the contract term.

6.3 Termination Notice: Either party may terminate the agreement with 30 days’ written notice after the initial contract term.

7. Service Levels and Performance

7.1 Service Speed: While ATS Connection will make every effort to provide the broadband speed advertised, you acknowledge that actual speeds may vary due to factors such as network congestion, equipment, and the distance from our servers.

7.2 Service Interruptions: ATS Connection will work to minimise interruptions in service, but external factors such as power outages, weather events, or third-party disruptions may affect service availability. We are not liable for any interruptions due to circumstances beyond our control.

8. Limitations of Liability

8.1 Service Interruptions: ATS Connection is not responsible for any loss of data, profits, or business that occurs as a result of service interruptions.

8.2 Data Security: We will take reasonable steps to protect the data transmitted over our broadband service. However, ATS Connection is not liable for any security breaches caused by third-party attacks or customer negligence.

9. Fraud Prevention and Responsibility

9.1 Fraudulent Activity: You are responsible for securing your broadband network to prevent unauthorised or fraudulent use. We advise you to take necessary precautions such as using strong passwords and restricting access to authorised personnel only.

9.2 Reporting Fraud: Any suspected fraudulent use of your broadband service must be reported to ATS Connection immediately.

9.3 Liability for Fraud: ATS Connection is not liable for any charges incurred due to fraudulent use unless the breach originates from our own system vulnerabilities. Customers are responsible for all usage charges resulting from unauthorised access unless otherwise proven.

10. Data and Privacy

ATS Connection handles all customer data in accordance with our Privacy Policy and relevant data protection regulations, including GDPR. Your data will not be shared with third parties without your consent unless required by law.

11. Support and Maintenance

11.1 Support: ATS Connection provides 24/7 support for all broadband services. You can contact us via our support hotline or email to report any service issues or request assistance.

11.2 Scheduled Maintenance: We will inform you in advance of any scheduled maintenance that may result in service downtime.

12. Support

13. Governing Law

These Terms and Conditions are governed by the laws of England and Wales. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts of England and Wales.

ATS Connection VoIP Telephone Services Terms and Conditions

These Terms and Conditions govern the provision of VoIP telephone services (“Services”) provided by ATS Connection. By using our Services, you agree to the following terms.

2.1 Eligibility: Our VoIP services are provided exclusively to businesses, and are not intended for personal, consumer use.

2.2 Service Quality: ATS Connection will use all reasonable efforts to ensure that the Services are available 24/7. However, you acknowledge that the availability of the service may depend on various factors, including your internet connection, power supply, and network configurations.

2.3 Geographical Limits: Service availability may be subject to geographical limitations, network conditions, and technical restrictions.

3. Licensing and Ownership

All equipment and software provided as part of the VoIP service remain the property of ATS Connection unless otherwise agreed in writing. You are responsible for maintaining and safeguarding the equipment while in use.

4. Customer Responsibilities

4.1 Access to Service: The customer must ensure that they have a stable internet connection to use the VoIP service effectively.

4.2 Use of Service: Customers must not misuse the Services or use them for illegal purposes.

4.3 Reporting Faults: Customers are required to notify ATS Connection of any faults or issues encountered with the Services as soon as possible to enable quick resolution.

5. Billing and Payment

5.1 Fees: Fees for the VoIP services will be invoiced as per the agreed pricing structure. Any usage-based fees will also be included in the billing cycle.

All customer data processed through the VoIP service will be handled in accordance with ATS Connection’s Privacy Policy and relevant data protection regulations, including the GDPR.

10. Fraud Prevention and Responsibility

10.1 Fraudulent Activity: The customer is responsible for safeguarding the security of their VoIP services and ensuring that there is no unauthorised or fraudulent use of the service. Customers are advised to take appropriate steps to secure access credentials and restrict usage to authorised personnel only.

10.2 Reporting Fraud: Any suspected fraudulent activity must be reported to ATS Connection immediately.

10.3 Liability for Fraud: ATS Connection is not responsible for any costs or charges resulting from fraudulent use of the VoIP service unless the fraud arises directly from a breach in ATS Connection’s security systems. The customer is liable for all usage charges incurred as a result of fraudulent activity on their account unless proven otherwise.

12. Governing Law
